My niece is presently based in Canada under a 2-year work visa which will expire in June this year. Just 2 months ago, she submitted her application papers for a PERMANENT RESIDENT VISA under the PROVINCIAL NOMINEE PROGRAM, as SINGLE in CIVIL STATUS. She is recently engaged to be married to a Canadian citizen and already expecting to give birth in Canada a few months from now. My questions are:

1. What will happen to her application for a Permanent Resident Visa if she marries her Canadian fiance prior to its approval?

2. Will her giving birth in Canada affect her application for PR Visa?

3. Is it advisable for her to defer the marriage until after obtaining the PR VISA? Kindly advise us what to do. Thanks a lot.

She will need to add her spouse to her application.

In fact if they have already been living together 12 months up to now, he needs to be added immediately to application as a common-law partner.

Not really, as baby will already be Canadian so doesn't need to be added as dependent. Can just inform the visa office after birth. They may want a new additional family info form filled in.

That is up to them, if they want to include him in the current PR app, or submit a brand new PR app for him after she gets PR as single.

And again if they have already cohabited for 12 months, this is not even an option and he must be added now anyways.
 
Rob: The OP indicates that the fiance is Canadian, so there is no need to sponsor them.

If they have been living together for 12 months, then she has to include him in the application, although she won't need to pay any fees, and he won't need a medical.

Thank you for the replies. Yes, the fiance is Canadian and they have been living together for almost 3 months now. The baby is expected to be born in October this year. So I think it would be better for them to postpone the wedding until after she becomes a permanent resident of Canada.

How long would it take to process the PR visa assuming all the required documents are submitted and in order? She submitted her papers to the Canadian immigration on the last week of December 2014.

Note that once they reach 12 months of cohabitation (so in 9 more months if app is still processing), it is then mandatory she change her status from single to common-law.

Since he is Canadian and doesn't need to be added as dependent, there really shouldn't be much or any delay if she changes her status with the visa office to common-law or married. There is no reason to delay a wedding because of this, if they really want to get married.

I have no idea about processing times for provincial nominee programs.
