Hi,

I have a relative who got Canada permanent resident visa recently. She is going through a personal emergency and may not be able to land in canada before the expire date. She is really stressed out these days because of this. Can anyone provide us possible ways that we can do to keep her visa valid?

Thanks!

She will have to re-take medicals and get a new visa from the VO. I do not know the exact forms she will have to fill. Have her contact her VO.

Rod

Thank you Rod! What do you mean by 'VO'. I worry that she may have to go through the whole application process again. If she can keep the visa by re-taking the medical exam, it is much better.

Thanks!

Unfortunately, there will be no chance for her to get any extension on her PR visa.

If her PR visa expires before she goes to canada and lands as a PR, she will have to go through the application process for the permanent residence from the beginning "the zero point", pay the processing fees, meet the new eligibility requirments, do her medical tests, and wait the normal processing time until they process and finalize her PR application.

Moreover, there is no guarantee that her second application will be approved.

Thank you very much Professional 1! She got back from VO. Same answer. So we have to prepare for the worst case. But one more question: does she have to submit all the application documents such as all the notary certificates? If those documents can be re-used, may save some of the processing time.

Thanks

In general, the visa office has the right to keep all of her documents that she has sent when she applied. Therefore, if they do not send her back any documents she can not force them to do so. However, sometimes visa officers send back some documents to the applicants after finalizing their applications but it is very rare, and depends on the visa officer individually.

I never got any documents back from the visa office after they approved and finalized my application, Although I sent them so many original documents not even notarized.

Therefore, let her be prepared to provide the same updated documents when she applies for a new PR application, as there is no guarantee that they are gonna send back any documents, so do not rely on that point.

The second point is to make sure that she meets the new eligibility requirments for the skilled workers, as the rules has changed since the time she applied.

If your wife has sponsored you, you cannot land. If you do, you will be committing fraud. You need to inform IRCC that your marriage has ended.
