hello friends,
i am close to get SINP nomination and planning to apply for work permit based on that. now my real problem is Overstay in canada. i entered canada as a student, completed my Bcom, and got a job, i applied for work permit, which i got. the problem is i overstayed 9 months after my work permit expired. i left canada by myself, there was no deportation or any legal notice. now i am in india, and applied for SINP.
Do you think my previous overstay will affect my work permit application? since its immigration related work permit means i am supposed to stay in canada. your reply would help me a lot
It shouldn't. Your SINP acceptance is already showing an intent to become a permanent resident. The VO assessing should not allow the overstay to affect the decision because you are intending to become a permanent resident by going through a provincial nominee program and applying for a work permit based on that. It's not the same as applying with an LMO.
thanks for your reply, i just hope that it doesnt make an issue here. kinda complicated situation, one way i wanna live in canada and the other way, i have to prove that i wont stay there.

hi there. i got the same situation. entered as student. and overstayed for five months. I got my nomination last sept 2011. and now I'm applying for a temporary resident visa. and soon will apply for pr. During my overstay, i applied for restoration of status and work permit. hence, i was allowed to stay few more months. but as soon as a decision of refusal was made on my application, i left canada. I compile all correspondence from cic to support my status. i will update you if i'm able to get a visa.
