Outland spousal - DEPENDANTS What would you do?

hi there,

Again, thanks in advance for anyone reading and taking the time to respond and help me work through this.

SCENARIO:
My spouse was in a previous relationship where he has a child, but the second child he was unsure it was his. Before we met she had told him it wasn’t his and they broke up because of it. He has asked for a paternity test and she has denied him. After getting married she tried to sue him for support for both children, he was behind 2 months on his payment for his first after being out of work. She tried to file for a year of support for the second child and is now saying it is his.

QUESTION:
I’m hoping he will be able to see both kids before we put in his application, so we can get the paternity test done, but if not would you still put the second child on the application or would you leave this child off it may not be his?

She currently keeps his actual daughter from him so I’m sure she will not agree with medicals. Will this affect my application.

WHAT WOULD YOU DO? Help! Any advice appreciated.

Opps! Sorry. I am sponsoring my husband. He has one dependant (non-accompanying) and the second child is questionable. Hope this helps.

This is my personal experience. I had a 1 night stand with an ex who got pregnant. She has always claimed the child was mine. I never believed it as this child looks nothing like me but looks like my ex and my ex’s ex boyfriend. Anyway, I wrote an explanation letter letting IRCC know of her presence and denouncing her as my child as I really do not think she is mine. I had no issues. I hope this helps a little.

Yes, I was. My application took less than 6 months.

The consequence of not listing the child your husband is claiming is not his on the app is that you will never be able to sponsor them down the road, which given the circumstances is clearly a non-issue.

The far bigger issue will be the medical for the non-accompanying child who is definitely your husband's child (you can't leave her off the app as that would be misrepresentation). Basically it will delay your application by a bit because IRCC will want to see that you tried your best in obtaining a medical and a reason why it's impossible. So there will be a bit of a back and forth during that stage.
