Hello All,

I need your opinion/advise for spousal open work permit visa

I am Canada PR but currently residing in my home country. I recently got married and want to bring my spouse there

Can I land in Canada and get the job n then straight away sponsor my spouse for open work permit ?

Though I know in parallel I will apply for spousal visa ( out land applicant ) and it will take more than a year as per New Delhi VO timelines.

So please advise me

Thanks in advance

No - your spouse cannot apply for an open work permit. The rule you are referring to only applies to the spouses of foreign workers in Canada. Since you are a PR, this rule does not apply to you or your spouse.

What do you mean by "Can I land in Canada..."? Have you already attended your landing interview appointment and then returned to your home country, or are you saying that you have your CoPR document and have not yet activated it?

OP landed in September per his profile timeline. I think by "land" he means return.

Hello Guys,

thanks for the response.

Yes " Can I land " , I mean return to canada

As I am not eligible for open work permit visa, then what are the alternatives so that I can bring my spouse in minimal timings ?

She could try applying for a visitor visa. Unfortunately there's no guarantee it will be approved.

Hello Scyllia ,

Thanks for the response.

Just got the below info from CIC website for open work permit , Please comment

Who can apply for an open work permit?

You may be eligible to apply for an open work permit if you are in one of the following situations:

You are already working in Canada and your application for permanent residence has received a positive eligibility assessment under one of the following :
Federal Skilled Worker Program
Canadian Experience Class
Provincial Nominee Program
Federal Skilled Trades Program
humanitarian and compassionate grounds
You may also be eligible if you are a family member of someone whose application for permanent residence has been approved under one of the above.

That rule only applies to individuals who have applied for spousal sponsorship using the inland method. In order to apply through the inland method, both you and your wife must be in Canada. In order for your wife to be in Canada, she first needs to get a TRV. The chances of a TRV refused are unfortunately quite high.

But you can certainly try. The first step is to apply for a TRV.
