Hello everyone!!!!. As a newcomer, i´m asking for some guidance:)
I´m from Spain, and my girlfriend is a Canadian from Calgary. We have been together for more than a year. Each of us live in our country, but every three months we meet in Spain or in Canada.....yes, it is a long distance relationship, and it is really hard.
We are thinking of starting a new life together, in Canada.
I mean, is there any chance to apply as a long distance relationship - common law partnership?. We can demonstrate that we have been together in several occasions here in Spain and there in Canada........
Please, any tips, experiences, advices or people in the same situation as us would help a lot!!!

Unfortunately to qualify for common law you need to physically live together for 12 months or more. So your options are to apply for an IEC work permit if you qualify by age, a study permit, express entry if you qualify or get married. Or the girlfriend can look at options to go to Spain for a year and then apply to sponsor you.

You also have the option to marry. At the moment, you are not eligible as "common-law" partners; you are merely "dating".

Do you think it is a good option to go to Canada with a tourist visa, get married and start applying through a spousal sponsorship?. Is there any chance to get a temporary working visa as you wait for a reply?.

This is not uncommon, and would allow you to submit an "inland" application, along with an "Open Work Permit" application.

Hello,

the problem of defining "common law partners" is very relevant also in this period with the COVID-19 pandemic.

My Canadian partner has been visiting me in France (where I live) for one month. I bought tickets to travel with her back to Canada and staying there with her for the entire month of August. I though they would let me in because I gave it for granted to be in a common law relation with her since

1 we are partners since 2008
2 We lived together in Toronto for about one year in 2009.
3 Soon after I became Canadian PR. However I had to migrate to France for work but I still visited her regularly. We ended up spending together about 3/4 months every year eversince.

Although the year we lived together is not this last year, can we make a case that we are common law partners as we enter the Canadian border?
