How LMIA works? I'm on PGWP. Because there is no ITA happening right now I'm worried that I won't able to make it in time while my work permit is still valid. I submitted my profile in November and waiting for ITA. In case that work permit expired, my current employer is willing to do LMIA. Does she needs to do interview and posting of the job for my position? Do I need to applied also for the job? Thanks

When does your PGWP expire? IRCC is letting people extend their PGWP if they expire this year.

And yes, your employer needs to advertise your job if you want to go the LMIA route.

Unfortunately that means you don't qualify for the extension that's been announced.

So it would be a good idea for your employer to pursue the LMIA.

When the employer applies for the LMIA, they must show evidence of advertising the job that meets the LMIA requirements and that they have considered other candidates or that no suitable candidates applied.

Your employer needs to read through the details instructions in the link below. If they aren't comfortable doing this themselves, then I would recommend they hire a lawyer to assist them.

My current employer posted and do advertise to different platforms including Job Bank. Do they need to do interviews even if they are not going to hire a new employee? My PGWP is expiring a few months from now. I got hired for the position last year. During the time when I applied, she don’t have yet Job bank account. If my work permit expires and we submitted the application for IRCC for a closed work permit (implied status, have application number) can I continue to work even if my SIN number is not valid or do we need to wait for the approval from IRCC before going back to work? After a month, our next step is at ESDC. How long does it take for the result from ESDC? Thanks.

Yes they need to do interviews to prove that they were not better qualified than you. They will need to keep track of documentation for the interviews and why you are the better candidate than the others. So you cannot apply for a closed work permit until LMIA is approved. Attached is the current policy which is valid up until end of February. So if the policy doesn’t continue, you must stop working, convert to visitor visa and wait for permit to be approved.

LMIA approval depends on wage stream but expect at least 30 days.
