i was kicked out with my son by my wife/ sponsor a canadian citizen. we have been going through the process since nov 2009, medicals done last summer . i am not working, have no means of support but her and she never has money to pay for my work permit. My son and i are now homeless. what are my options . do we have to leaveso close to getting our landed status. please help
 
You do not have to leave unless someone tells you to. What is your status now? Do you have inland first stage approval or are you on visit status?

You could go to a shelter for the time being. If your wife withdraws her sponsorship, you will not get your PR. It will also be hard for immigration to get a hold of you for a landing interview if you are not living there any more. It does not sound like your wife would tell you if she were to receive a letter for you from them. On top of that, if you were to go to a landing interview now and tell them that you and your wife are no longer together, I also don't think they would give you your PR and if you don't tell them, it would be misrepresentation.

Any chance of reconciliation?
 
this has happened too many times been kicked out a few times now...she knows she has that control and uses it.so your saying i have no options at this time to possibly stay here.
 
That is right. No options but to wait for the PR.
 
thats really sad, dont worry RT20 just have patience and once you get your PR you can make her life a little tough, since she is the only earner you are entitled to half her assets . You know what to do next, good luck :)

That is not necessarily true! And are you implying he should go on welfare after receiving PR to really stick it to his wife? What a great use of the Canadian immigration system!

The OP has a lot to consider here. The sponsor will probably withdraw her sponsorship if there is no reconciliation. And if she doesn't withdraw and they don't reconcile, the OP is not a member of the family class and will not be eligible for PR. But if she would kick out her husband and a CHILD, I sincerely doubt that she would allow the sponsorship to continue knowing her financial obligations after PR is granted. It doesn't sound like she is the compassionate sort. This is a sad situation.

The OP needs some legal advice and should go to legal aid to try and get some for free. And also to the local welfare office to get some financial assistance to take care of themselves and their child, at least for the short term. And I hate to say it but they should also consider going back to their home country where they will be able to work and support themselves and their child.

This is exactly the type of "hammer over the head" situation PMM described when we were discussing what could happen with spousal conditional visas. Ugh!
 
im not interested in getting revenge...it will come back to her..i will speak with her and see if she will continue with the process . if she chooses not to i will go get legal advice and or to the immigration office tell them what has happened and then go from there. is she still responsible for us if we go on welfare
 
I am not sure if she is responsible for you until after you get your PR. The sponsor is responsible for 3 years after you get your PR. I don't know about before.

No, not before PR. Then you are getting into family law issues. Best of luck.
 
I believe it is pre mature to go on welfare unless absolutly nessasary. Should you and your wife reconsil, and you have used welfare it could cause you to be ineleigible to be landed. What happens if you are fighting this week and 3 weeks from now you are getting back together..it will be too little..to late if you have gone on social assistance.

* Try to work it out. It is in the best interests to all involved. (Unless this is a abusive situation)

* Look for a friend or someone who would be willing to assist you with the $150 to get a work permit and apply. Even if you need to ask
family to western union it to you. Show her and yourself that you are a man and you can try to contribute. Even if try is as far as you get.

* The comment about shelters is right, they are there just for these types of situations, and perhaps you have some friends or family in
Canada who might be willing to help you out in the mean time.

* Consider the idea that you may need to return to your country, start looking into how you will manage that if it comes down to it.

i have no family to speak of . so my most pressing concern is to find food and shelter for my son and i. i appreciate the advice i have received. i have been doing odd jobs to help make money for our family . the extremely oppresive situation i have put myself does not allow me the chance to advance. now that i know my options are very limited i will have to look at trying to get back to my country as soon as possible
