This is really something you need to discuss with your lawyer because you must be able to prove that an error was made in your asylum claim assessment and refusal.

My previous lawyer messed up my appeal and I ended up getting dismissed- I just got myself a new lawyer, the new lawyer told me, I have a small chance of winning my JR but we should do it. My Question is “do I have a chance to submit a new document in JR or I do not”

Your lawyer has said yes.

If your chance of JR is relatively low you also need to think longterm. There is not an easy pathway to PR these days.

You can file for JR but chances are low. Don’t know how your lawyer messed up and what the error in law is so file and see what happens. Need to make plans if JR is refused too.

She said because of my credibility, that she won’t guarantee me a high chance of getting JR - and she said if JR fair, then I can proceed to H&C due to my mental issue - I might have a chance for H&C

So plan for H&C which will take years. What is your status now?

I’m still a refugee claimant (Failed refugee claimant)

Very hard to predict what will happen with H&C because reforms must be in the pipeline. You should not count on H&C and hopefully you are addressing your mental health now to better your life in general.

Please what did you mean by “reforms must be in the pipeline” and my Therapist said I need a serious attention, like a serious medical attention for the fact that I’m having issues with memory lost sometimes

There are too many people applying for H&C with a limited number of spots and the program has become a catch all for anyone who doesn’t qualify for any other PR pathway. The H&C was initially created for a small number of exceptional cases. You are receiving care for your mental health issues at the moment which doesn’t guarantee that you would need to or can remain in Canada longterm.

No, I’m not receiving any care or treatment for my mental health and moreover Government didn’t pay for my Therapy - I’m thinking going for a real medical care with my money myself

But what can I do, I’ve been living with my partner for over a year now, he’s also a refugee claimant but waiting for his hearing date - I have another relationship outside with another partner (Trans) that has a PR - I don’t know what to do
