I need to get a grip. Sent out the package and I'm super anxious. I also need to know if I did this wrong.
We applied outland. My wife has a TRP allowing her to visit and stay in Canada (it's multiple entry) because she used to be inadmissible (we got permanent rehab). Where we live in Canada is a walk away from the USA. So, when I bought a house and moved in December, my wife came with me under her TRP.
She spends every night here and sometimes doesn't even cross back to America for a few days. But, she does cross most days for school, work, and to pay bills, etc. She does have a Canadian cellphone (because she's on my plan) but all other bills and stuff are in the USA as is her official residential address where she gets her mail. Now I'm worried because I put on the form that she doesn't live with me but visits nightly. Is this misrepresentation? Will CIC say that she is living with me and I lied because she visits every night and sometimes stays longer than overnight? Will it be an issue that I listed her US address as where she "lives" even though she rarely spends a night there?

Ok so there's no chance that CIC is going to see that she spends 99% of her time here and deduce that we lied about her living here? I put in the notes that we are being honest in that she visits nightly and spends most of her time here but still has a US address, employment, etc. We used her US address. We also put that she was denied entry to Canada once because a border agent believed she was actually living in Canada under a TRP.
I've just heard stories of people being charged for misrepresentation for simple mistakes and I feel like saying she isn't living with me when she spends 99% of her time here is much more than just a simple mistake. :/

Oh ok good. Thank you so much. I checked off that we aren't living together and are applying outland and noted multiple times in the document that she does visit nightly and spends most of her time here. I'm just trying to be as transparent as possible with them but there wasn't an option for "Spouse lives with me temporarily but has US address and we are applying outland" . Thanks again. I'll get some tea and try to calm myself, lol.

Maybe take some time away from the forum and anything immigration related. From what you have said, you guys have disclosed everything and covered your bases and should be fine.
The only time that happened it was with a large port of entry where they didn't know us (we had never crossed there before). Our usual daily port of entry has given us no problems over the past year. The agent at the problematic entry had told us that he could charge us with misrepresentation and ban my wife from Canada for over 10 years because he believed she was living in Canada on her Temporary Residence Permit (not TRV). Luckily he just had us sign a withdrawal form. That's where all this anxiety over misrepresentation stems.
