Hi guys, I am a Canadian citizen thinking to do an inland spousal sponsorship application for my partner from Portugal.

He does not have status here. We are set to get married this upcoming September. We have been together for 11 months, I have many receipts and pictures and Facebook messages dating back to December the earliest, he also has a sister who lives here with her husband as a PR which im hoping will help his case. I am 22 and he is 23.

My concerns are the following:

Although I'm a college graduate, I am currently enrolled in a new program at school and at this time I do not work or make any income. I live with my dad who has enough income to provide for both myself and my partner. Will this affect our application?

Second, my partners passport expires in January 2018. If we send our application in November or December, will this be an issue that after we have sent the application his passport is expired? If so, should we do outland instead?

Third, if we get married in September and then directly after that my partner goes back to Portugal so that we can start the outland application, is this going to be an issue with immigration?


Please give me any advice you guys have it would be greatly appreciated. I really want to make the right decision for us I am so nervous about losing him.
 
This is confusing. You say you want to do inland, but do it outland.... which is it?

Passport should be valid for at least 6 months after PPR is sent if you are approved- i would have him renew it right away
there is no minimum income requirement. you can send a letter of explanation as to your plans and why you dont have a job etc
it wont have an affect if he goes back to portugal..
 
Hi, sorry I should have been more clear.

Basically, I am saying that I would like to apply for inland sponsorship application for my soon to be spouse, however I was wondering if given my circumstances outland would be the better option.

If your partner isnt living canada you cannot apply inland. You said he is going back to portugal so outand is what you will do.
 
just wondering if its best to do inland even though he has no status here, or for him to go to Portugal and do outland
 
Thats totally up to you... both are the same processing time. With inland you can get an open work permit if not you need to extend his stay. Outland youll need to extend his stay past what the border agent gave him.
 
The thing is he has already overstayed... no status means illegal. hes over stayed by about 7 months now. I was wondering will it make a difference to immigration if I apply inland I have no job and we say that he "isn't working" will this be an issue? is it safer to tell him go back to Portugal and we apply outland? he cant get an open work permit now that he has over stayed his time
 
Id go back to portugal ASAP. Not sure what implication that has on the app. My usband has always had status here legally. Good luck
