Hello,

I am in the process of appealing after my refugee has been denied. My spouse wants to marry/sponsor me in hope that we will not be separated if God forbid that the judge doesn't grant me my appeal to federal court. I am unsure what would be the best choice to do an inland spousal sponsorship, however if the judge doesn't grant my appeal, does that mean my inland sponsorship will be denied? Should we wait to apply sponsorship ONLY when I get the answer if my appeal has been granted or proceed with the sponsorship application now? I do not see doing an oversea sponsorship for me due to I will be at the other side of the world from my spouse and I will not burden him to do so.

Any expert opinions help!

Apply outland. If your refugee case is refused, it's possible you could be removed from Canada. If you apply inland and are then removed from Canada, this would cancel your inland application. Outland is the better option. Your spouse can sponsor your outland while you are still in Canada.

You will want to provide extensive evidence that your relationship is genuine in the sponsorship application. CIC will most likely examine your application quite closely to ensure it's a real relationship given your refugee claim.

Should my appeal be refused, do they make exception and consideration to postpone until my sponsorship has been approved? Also, does that mean it's best my spouse and I begin the sponsorship application as soon as possible?

Yes - your spouse can sponsor you outland while you are in Canada. No - this won't prevent you from having to leave if Canada orders you to leave. But the application won't be canceled if you are forced to leave Canada.
