Hello there

I have question basically I apply for PR under family class and I'm worry my application to be refused
because of my charged about 2 years ago ,i got charged with (Obstruction peace officer ) and I paid fine was 50$
it's the only charge I have on my record ,it happened in Edmonton AB Canada ,it was a summery conviction so now I'm thinking to apply under humanitarian and compassionate grounds but I don't know how to do that,does anyone know how to apply for that,please if any one can help me ?

What is your humanitarian and compassionate reason? They would only consider H&C apps in cases that involve young children, sick people, persecution in their home country, etc.

Definitely not. That is just a normal sponsorship case. H&C is reserved only for cases with special considerations.

In all honesty, be reason of having a wife would be a strong case for H&C reasons at all. There have been denials to those sponsored due to prior criminal records, both inland and outland.

Even with apply for TRP would be hard to get. As long as you got a conviction in Canada, CiC will consider criminal record for all immigration visas and permits.

I know it is a small conviction in a sense that it is a 50 dollar fine. The offense still falls under the criminal code and thus considered a federal indictable offence even if it is an provincial offense. Same goes for those who are charged with DUI even though it is under provincial jurisdiction.

Unfortunately, it only takes one.

You should consult with an experienced lawyer to determine if you are in fact deemed inadmissible to Canada because of this. Maybe you are, but then...maybe you are not.

If you are, s/he will be able to advise you on what (if anything) can be done.
 
Were you arrested and then paid the fine once you appeared before the judge?

Or were you issued a citation by the peace officer and paid the fine?
 
i talk 2 lawyer one told me that I'm admissible to Canada because it summery conviction and second lawyer told me not and he told he would take my case for 2000$ so I'm confused what should i do .
 
How long ago was this? If necessary (in your shoes), I'd apply for 'criminal rehabilitation' myself, rather than forking over two grand, that would come with NO guarantees. Many here can enlighten you on how to do that.
