In order to be found eligible for processing by the Centralized Intake Office in Nova Scotia, Sydney, you must have at least one year of full time or equivalent employment in an occupation listed in the 38 NOCs under Ministerial Instructions.

If you are found eligible, your file will be forwarded for processing to a visa office. During processing, you will be awarded points for experience in any A, B or O occupation as listed in the NOC, even if it is not one of the 38 NOCs listed under Ministerial Instructions.

its sad to hear about that.
there is one rule that always remained valid.i.e.
Visa officer if not satisfied can reject a application. and visa officer can consider an application even if it lacks points on his own feeling of success of applicant in canada. maybe the visa officer was not satisfied of validity of your work experience. can you please post the complete letter from CHC here.

Don't loose hope, u can consider alternatives.

Yes NOC 7216 is in 29 ministreal List but other NOC 1221 and 2147 is not in Ministreal list here is detial of All my work experience

NOC 7216 Electro Mechincal Supervisor May 2009 till present Country Saudi Arabia

NOC 1221 Administrative Officer Sep 2005- Dec 2008 Country London U.K

NOC 2147 Computer Network Eng Jan 2002- Aug 2003 Country Pakistan

Currently Total Years of Work Experience = 6 Year 2 Months

so If I am not wrong all my work experience falls in last ten years

can you share your views.

I presume at least one of 7126, 2147, 1221 is on the ministerial list. If yes and if you have conducted all these jobs in the last 10 years, then you get all the points for work experience.
 
You should get maximum points for work experience.

Hi belize,

I am very sorry to hear about your case. I advise you to appoint a good lawyer. Discuss your case with the lawyer and confirm that the lawyer is convinced first. I think you still have a time since your second rejection has come few days ago ( discuss this with the lawyer as well). Of course it is a matter of $5000 but I think you should give a final shot and fight for injustice. You can earn your lost money in futute but you cannot reverse the time which you have now, for the appeal. You can earn this money in a month or two. If you succeed (may God help you to win this battle) it is well and good if not at least you the satisfaction that you have fought until the end. So think about this, if you think your rejection is 100% inappropriate and if you have all necessary proofs, then go ahead and appeal.

You will find some way inshallah.

For your information other NOC codes were not considered as they are not in the list of approved occupations according to the ministeral Instructions of November 28 2008, Should you have different or additional information, you may wish to submit a new application for Permanent Residnece in Canada.

In minister instructions clearly says if ONE NOC code match all NOC should awards the points as long as fall in skilled A O & B, I don't know embassy make own rules they should follow the minister Instructions but they are not doing that. I got 66 points but if they count all my work experience I should get 71 Now I dont know what should I do I sent them Link from CIC web site but still they not agreed. I worked so hard in my life and gain all experince but they are not giving me points. Just looking for Justice I follow all minister Instruction but Embassy Not.

friends i am having sleepless nights after knowing belize's case.. i applied in november 2009, and presently waiting for meds..i applied in noc 4131 as computer instructor and other noc is 4141 (secondary school teacher) if like belize only 4131 is accounted for then my point will be only 66.. which is not going to be accepted ... or otherwise it will be 71 . i am really worried ... pls help me seniors... my ielts (GT)is 7 ..please share your views it will be highly appreciated

2 - please provide exact wording of Schedual 3 page 2
3 - please provide exact wording of your all refrence letters regarding work experience
4 - what is your educational qualification?
5 - First refusal date and refusal office?
6 - did you apply for CAIPS Notes for your case?

hope if you provide the above required data we can find the actual problem and can find a better solution for your case.
