If you take a look at my timeline, everything was going soooo smoothly until the doc in Greece lost my common law hubbies medicals, and he had to do them again in Canada. His visa expired Sept. 7th, but CIC said it would be ok until his old medicals ran out Oct. 19th. Last month we sent the app to extend his stay, and today I got a letter back asking for a photocopy of his passport- which is being held in Rome until they receive the new medicals!!!! When I called CIC today, they said that he has implied status (even though his app for the extension was returned due to lack of papers) if he returns the app within 90 days of receipt.Help!!!!! Oh, and they're asking for $200 CDN for the app- I didn't see anything about paying that, mind you this whole procedure has me climbing the walls, no wonder I'm so confused!!! :-[
The $200 and 90 days they're talking about is for restoration of status. If they've refused his extension due to lack of required paperwork, you'll need to pay that and resubmit within 90 days to get him back into status. He's actually out of status until then.

If they issued the visa, don't bother spending $200 on restoration of status. He can get the passport, land as a PR and get into status that way. Most likely he'll be landed long before they'd re-process the extension/restoration of status anyway, so there's no point sending it.
From my experience it seems like "implied status" is a term that the agents like to use when they have no idea how to answer the question of the legality of someone's stay here. Also, it's Immigration Canada, a government thing... except the unexpected especially when it comes to money.
I would strongly suggest for you to apply for the restoration. We got a letter from Immigration Canada about 2 months after we sent our application saying that my husband needs to leave Canada voluntarily since he didn't have a status. This was after we inquired about the validity of his stay here since he lost his Visa a month after the application was sent. We were told of this "implied status" but apparently not all of Vegreville honors this unwritten rule. Luckily, we got him visitor status for a year after shelling out $200.
