Also depends on your previous history in Canada before applying for H&C. It is really a last resort option and should only be pursued if there are no other pathways to PR. This is especially the case if arriving as a visitor and applying for H&C.

time spent in Canada can help but it's not like a calculator like when you stay here for a long time so you will be able to apply for residency under h&c! duration in Canada is part of the establishment factor but in H&C applications there are 3 important factors ! also establishment can be strengethened by other arguments , 5 or 10 years in canada without any integration will not really help !

You missed the point. If you remain in Canada with an H&C application you about a 50/50 chance of success. If you are removed (and CBSA does have a mandate to remove illegal immigrants, including those without status, like H&C applicants) your chances of a successful claim is essentially zero. There were 16,000 H&C applications in backlog as of December 2020. Assuming an 80/20 split (in Canada/out of Canada), 5-6000 applications might be fortunate enough to have a successful application in the future.

In 2017 – from outside of Canada success was 1.7% and from within Canada 57.8%
