My boyfriend, also my common-law partner, just becomes a PR of Canada. I am holding a 3-year post-graduate open work permit, which will expire exactly 1 year from today. Since I spent last two year working aboard, not in Canada, I am unable to apply for a PR status on my own. Now, my boyfriend is starting to help me to apply for my PR status based on common-law sponsorship. Both of us live in Canada together right now and we have sufficient evidence to show our relationship. My questions are as followings:
1.Shall we fill out applications for applicants in Canada, but send them to CIC's outland offices? So that the processing time, ie. Stage One, can be shorten?
2. Can I send my request to extend my workpermit along with my PR application? When will my work permit be issued under best scenario? And, what would type of that work permit be?
And you were medically examined? If yes, here are your answers.
1. Complete the forms for overseas sponsorship even though you are living in Canada. Choose either your home country or Buffalo as your processing visa office.
2. No, an oveseas PR application cannot extend a work permit. That is only available to inland applicants.
First stage processing is different for overseas vs. inland sponsorship. First stage for overseas is approval of the sponsor to be a sponsor. First stage in inland is that plus approval that the person sponsored meets the criteria to be a member of the family class (relationship is genuine and not entered into for the purposes of gaining immigration status under the Act).
Sorry, there was a huge misunderstanding I made for your last question. We declared our common-law partnership After he landed in Canada as a PR.
Under such circumstance, what the answers to my previous questions would be?
Also, if the PR processing time will go too long and if it cannot be issued before my work permit expires, can my boyfriend help me to extend my work permit? If he can, will it be an open work permit?

Anyway, big mistake. He cannot sponsor you as his common-law partner now because he should have included you in his application for PR and you should have been medically examined. He is now in danger of jeopardizing his own PR as he misrepresented himself.

Have you and your boyfriend lived together for one year at least? If not, he can't sponsor you as his common-law partner yet; if yes, he should have declared he had a common-law partner on his own PR application, and since he didn't, he won't be able to sponsor you now.
If you haven't lived together for a year yet, then I suggest you live with him for a year in Canada, and then get him to sponsor you as his common-law partner. Make life easy on yourself and get a lease or mortgage with both your names on it, a joint bank account, utility bills in both names, and other financial proof you are a couple.
