My second H&C application is refused today

I will apply for the judicial review just preparing my files ready, I would just like your opinion on how to address this.

The applicant, spouse and step-daughter came to Canada on valid status but unfortunately the applicant, her spouse and the applicant’s step-daughter are now out of status. They made multiple attempts to apply for permanent residence and to extend their temporary status but were unsuccessful. The applicant states that they are currently in debt to the Alberta government of approximately $40,000 due to medical expenses related to the birth of her child and her step-daughter’s medical condition. I find the applicant’s financially instability a negative factor in this assessment. The applicant and her family made a decision to remain in Canada when their status expired which resulted in them no longer having medical coverage. Although this situation is difficult for the applicant and her family I find that this is a situation was not beyond the applicant’s control.

There are more this just one I will post it too. I am waiting to file my JR if anyone knows how to make self representation please help me. I know I can put this application on JR and make another application and address new evidence and argument

I think JR is very complicated process not sure if you can do it yourself. Most likely you need a good experienced lawyer. Plus you have only 15 days to apply for JR. Im so sorry to hear that it was refused I dont understand why they take 9 months to say no!

But it’s doable, I am looking for a lawyer to look into my file but then again I am planning to apply for the 3rd one.

I did when they send in my refusal letter it is attached, All I can say Is I have a strong case but it’s a tunnel vision not to look deeply on the type of hardship that I may face. So I hope that this will resolve I will keep updating this group on what will happen

Hey, ECAS is only for paper based to check status. For online application, you need to call to know your status.
