H&C Humanitarian Ground with/or Without Failed refugee claim

Yes this is my first H&C application for my parents.
Factors :-
1. They are aged and have no siblings/parents back home, all immediate relatives are in Canada, United States and Scotland.
2. Their elder son (my brother) is a patient of Schizophrenia and is dependent on his father for which got a recommendation letter from his doctor in a Civic Hospital. (My brother is a Canadian Permanent Resident)
3. My father is a social worker and always contribute more than 1000 Volunteer hours every year in Canada for different organizations.
4. My father is on Work Permit and contributing to Canadian Economy.
5. Some other factors like investment in Canada so far and proposed investment plan.

If your brother is fully dependent on your parents your parents have a better chance than other parents but if they are older then they will not be able to care for your brother and financially support him longterm. It also appears that you only immigrated in 2020 so your parents must have had a plan for living in their home country if you only recently immigrated knowing there was no guarantee they could move to Canada/abroad. Their application likely depends on your brother’s health/medical history, their longterm ability to care for him if necessary and their ability to support themselves while in a Canada.

In 2025, IRCC plans that 1,262,801 temporary residents will leave Canada, a significant increase from the 588,409 departures estimated for for 2024. The planned numbers of people leaving Canada decreases in subsequent years, with 1,104,658 temporary residents expected to leave in 2026 and 875,129 in 2027.

Some immigration stakeholders are skeptical of these projections. They argue that many temporary residents will choose to remain in Canada by filing Humanitarian and Compassionate applications, seeking asylum, or pursuing other avenues to stay.

The 2025-2027 Immigration Levels Plan is clear that if a large numbers of temporary residents remain in Canada and do not leave, adjustments will be made to the levels of new temporary admissions to maintain the government's target of 5.0% temporary residents in the population.

In practical terms, this means that for every worker or student who stays in 2025-2027 and does not leave as planned, one fewer worker or student will be admitted in the future.

In looking at this chart it is not difficult to envision a scenario where future cuts to international student or foreign worker programs could be much more severe than those seen to date.

To achieve these projected outflows, IRCC will need to ensure that existing temporary residents do not extend or maintain their status. It remains unclear whether this will be accomplished through legislative changes, program reductions, higher refusal rates, or prolonged processing delays that may frustrate individuals into leaving voluntarily.

Asylum reforms coming in the next few weeks and assume H&C will be next since the volume of H&C has completely overwhelmed the system. The H&C process was meant for exceptional circumstances but has become a catch all for anyone who can’t qualify for PR via other programs. Canada has a very generous immigration system but it has to get tighter and more strict to reduce numbers.

No but recent announcement about PR targets do. IRCC is reducing quota of H&C applications getting PR. The H&C quota also includes special H&C country specific programs as well. There will also likely be an attempt to try to have those with a negative H&C application removed. Many have been able to keep filing H&C applications after refusals.

Measures designed to achieve the 5% target

• International student cap: IRCC introduced an annual cap on international student study permits, including a further 10% reduction in 2025 relative to 2024 targets.
• Post-Graduation Work Permit Program (PGWPP) reform: IRCC tightened eligibility requirements for the PGWPP to better align the program with immigration goals and labour market needs.
• Temporary Foreign Worker Program reform: Employment and Social Development Canada introduced a 10% cap on employers hiring temporary foreign workers under the low-wage stream, and announced an increase to the starting hourly wage for temporary foreign workers in the high-wage stream by 20%.
• Limiting work permits for spouses of temporary residents: IRCC is tightening work permit eligibility for spouses of international students and temporary foreign workers.

That should not be the case. Many strong cases have been refused by certain biased officers, then received approvals by fair operating officers. The first reform for H and C program should be establishing clear eligibility criteria and allowing only cases involving best interest of children and severe hardship in country of origin, and restricting parents/grandparents because they have their own program PGP.

Did he receive an approval ? When did he receive his AIP ?

That should not be the case. Many strong cases have been refused by certain biased officers, then received approvals by fair operating officers. The first reform for H and C program should be establishing clear eligibility criteria and allowing only cases involving best interest of children and severe hardship in country of origin, and restricting parents/grandparents because they have their own program PGP.

The H&C program was never meant to allow for repeat applications. It was meant as a final option for exceptional circumstances. Canada lack effort in removing people without status has allowed people to keep refiling H&C application at a huge cost to taxpayers. Long processing times in many programs and the generosity of H&C programs has also lead to more H&C applications.
