I'm currently into H&C program approved already on stage 1 assessment. I have following questions to ask and hope you can help me on this:


1.) I had an immigration consultant before but the agency no longer continue their services, Should I look for another one or Is it necessary to have one? A family member will do as a representative?

2.) I already sent out my application for open work permit, If once approved, Can I possibly go out from Canada and come back while my permanent residency still on process but holding an open work permit?

3.) If we have clarification with regards to my application, can we send a letter directly to Humanitarian Niagara Falls (4318 Portage Road Niagara Falls)

1.) since you got you 1st stage approval you don't have mush to do in the 2sd stage, only wait for IRCC to ask you ( Medical exam, Paychecks, Police Clearance Certificate, Schedule A, valide Passport) so you don't need any lawyer, consultant nor representative. Just make sure all correspondence adresses are yours so you don't miss any communication from IRCC.

2.) Did you have a valid status or are you out of status? Work permit obtained by H&C don't give any legal status, so you can't re-enter with it. Here you can see the remarks on Open Work Permit: https://ibb.co/dkXquf

I would not advise anyone with H&C application in process to go out of Canada, you will need to show paychecks or atleast that you make some efforts to find work.

When did you apply for H&C and can you share the grounds?

I applied for H&C as well. They started processing it in March 2018, but my lawyer have not heard anything as yet.

1. We received your application for permanent residence on July 6, 2017.
2. We started processing your application on March 12, 2018.

I was wondering, can you please let us know if your application was updated online? If yes, what was it updated to when you received your AIP. If you can kindly let me know

I wanted to ask you all something about my H&C application. I applied for H&C application but in July 2020, when I was going out of status, I left Canada and came back to my country since I didn’t want to be illegal there. I just want to ask that will they give decision on my application now?

Yes you will still get an approval/refusal on your H&C application

Thanks. Since I am out of country, will my study visa be approved while H&C in process? My H&C application changed to In Process this november but now I want to study further so can I come to canada for my further studies?

You are unlikely to be approved for a study permit because your H&C application makes it pretty clear that you don't plan on returning to your home country after your studies. You should definitely try but the H&C application creates obstacles.

Thanks Canuck78. So I want to ask that what foes the it mean when my H&C application went “in process?” Does that mean I am close to decision? If I want to know to which MP and in which province my file had been transferred, how should I know?

Very hard to say how long it may take. Could be months but could be a year.

No you'll need full approval.
