I am US citizen living in US and she is CAD citizen living in CAD
So we are filling out imm5533e and I read on first line for sponsored persons (Item#5):
"Reminder: To apply under the Spouse or Common-Law Partner in Canada Class, you must be living with your sponsor in Canada"
My goal is to apply as outbound but as a spouse.
I see that under that heading, ONLY if I am "currently living in Canada with my sponsor, and I am applying under the Spouse or Common-Law Partner in Canada Class" does it permit me to click a box that says I am also applying for an OPEN WORK PERMIT APPLICATION... does that preclude me from applying for that at the same time or no?
Is the detail "Spouse or Common Law Partner IN CANADA Class" The thing that will let me still move forward as a spouse out of the country? Is there a "Spouse or Common Law Partner OUTSIDE OF CANADA Class" or something of that nature?
In essence, Ive read that you can choose to be outbound applicant as spouse, but this application for her to be a sponsor seems to contradict that.
That passage isn't telling you that you can only apply as a spouse if you live in Canada, it's telling you that you can only do the inland sponsorship if you already live with your spouse in Canada. You can only apply for the open work permit with inland sponsorship. Remember, the Family Class includes spouses, so when it's asking you if you live outside of Canada and applying under the Family Class, that's the option for sponsoring a spouse outside of Canada (outland sponsorship). Yep, your first sentence is correct. You cannot apply for an open work permit if you are doing outland sponsorship. If you are doing inland sponsorship, you can apply for the open work permit at the same time you submit your sponsorship application.

The sponsorship process is to get permanent residence in Canada. Permanent residence gives you the full right to live and work in Canada, so you don't need a work permit once that's happened.

Once your spousal sponsorship is approved, they will send you a CoPR (Confirmation of Permanent Resident). You trot along to the border with this, your passport and your 'goods accompanying / goods to follow' list and tell the nice CBSA officers that your are landing to declare PR. They will deal with both your CoPR and your goods lists and hand you the stamped copy (they send the original on to CIC Sydney for them to issue you a PR Card - takes about 3 months).
Then same day or soon after, trot into any Services Canada office (loads around) with your passport and your stamped CoPR and tell them that you want a SIN number. They will issue you with one and that is it - you can now work anywhere in Canada.
