Federal Skilled Worker ..Continuous only ? What ??

Hey Guys,

I was just checking my eligibility under the FSW program and I came across 2 contradictory statements regarding points for work experience and was wondering if any of you can clarify this for me:

It says on the FSW site that the work experience (outside of Canada) must be at least 1 year (I have about 2.5 in total) ...and in one NOC code ....but does not say "in one job only"

BUT....

When you go to fill out the Come To Canada website, it says that it needs to be in 1 job only ?????
"..In the last 10 years, how many years of skilled work experience do you have? It must have been continuous, paid, full-time (or an equal amount in part-time), and in only one occupation...."

I graduated in 2012 and got a full-time job in NOC 2175 in New Zealand on September 2012 to July 15th 2013 and my 2nd job started July 16th 2013 to Jan 17th 2015

I didn't have a gap or day off transitioning between those 2 jobs. BUt they're 2 jobs ........and CIC won't count that ? And will only count 1 year in total (in my 2nd job ) ???

This is what basically will make or break my eligibility for FSW to get into the pool.

Can anyone clarify this for me please ??

Hey Michael,

I'm CEC so FSW isn't my area of expertise but I suspect this is due to the difference between the meaning of job and occupation.

They're fine with multiple jobs so long as they're in the same occupation (i.e. vocation/industry+role).

If that makes sense?

So If i don't have any "unemployed days" between Sept 2012 and Jan 2015 , will they count it ?

I got FSW as well even though my NOC codes are different from when I was working in the Philippines. NOC 2175 here in Canada and based on my work from the Philippines, NOC 2174. I submitted all the requirements even though they're from different NOC codes.

The applicant must have accumulated at least one year of continuous full-time paid work experience, or the equivalent in continuous paid part-time work experience, in the occupation identified in their application for permanent residence as their primary occupation, that is listed in Skill Type 0 (Managerial occupations), Skill Level A (Professional occupations) or B (Technical occupations and skilled trades) of NOC 2011. [R75(2)(a)]

Let's look at what full-time work is defined as:

For FSW applications received on or after May 4, 2013

Pursuant to R73(1), “full-time work” means at least 30 hours of work over a period of one week, and pursuant to R73(2), “work” means an activity for which wages are paid or commission is earned.

So, that would be continuous (no gap), full-time (if it's at least 30 hours), and paid. That would (as the rules are written) qualify.

But if you have previous experience, even non-Canadian experience, it wouldn't matter what the NOC codes are, as long as you have the experience, and you logged them as work, right?

Currently, I have almost 2 years full-time Canadian work experience (no gaps, all from the same company), but all my previous work experience from the Philippines are less than a year, and from different NOC codes (if basing them with the CIC NOC codes)

I also have foreign work experience under different NOC codes.
In my EE profile I claimed points only for the NOC that matches my primary occupation, and for which I have more than 1 year Canadian experience and 1 year foreign experience.
This is because I thought that I'm allowed to claim points for my foreign work experience only for the same NOC code under which I'm applying.
The good part is that if I get invited I won't have to bring supporting documents from previous employers for the other 6 years of foreign work experience
