My Father's brother who is 58 years old is mentally retarded and I am his legal heir. He is currently living in India with my Father who is 80 years old, I am citizen of Canada. After my Father's life, Is it possible to sponsor my uncle to come live with us? Wanted to explore the options before taking the decision to move back, as it will be hard on my kids. As said you cannot sponsor him to come live in Canada. He could try for a TRV but he will need to show his own funds, travel history, ties to home country etc. Getting approved will be very difficult. He will not have access to any care in Canada either so make sure he has travel/health insurance.

There are other options that moving back to India. You could hire caregivers to stay with him. Depending on how independent he is and his living situation you may even be able to exchange room and board for some cooking and cleaning if your uncle can be left alone during the day.

Thanks for your response. I have a remote job, so I can manage taking care of him. He is very gentle and just need some verbal guidance on carrying out his routine. I am trying to figure out the options for him to come to Canada.

You mention having children so your whole family would have to move to India even if you can keep on working remotely. You also may not longer qualify for benefits provided by the Canadian government although that will be dependent on CRA. You’ll need to inform them that you are leaving Canada and they can assess whether you would remain and tax resident and what benefits you may qualify for. If you are living abroad you are unlikely to meet the residency requirements receive healthcare in whatever province you have been living in. You would need to reapply for a new health card when you returned to Canada and are planning on meeting the residency requirement needed to qualify. 6-12 months in the first year depending on the province. Your only option for your uncle to remain in Canada would be as a visitor. Getting a TRV would be difficult although no harm treating. He could also attempt to get PR via H&C but that isn’t guaranteed. The biggest issue would be getting to Canada in the first place.
