I got married on paper in India and got marriage certificate. I was a PR at that time. I was planning to sponsor her but things didn't work out and we had to seperate.
Now I have a fiance and I will be sponsoring her after marriage.
My question is about a document mentioned in checklist which goes
For divorces obtained in this country, please submit a complete divorce petition, a judgement and a Final divorce decree.
So I wanted to know if this document is to be submitted by me as a Sponsor or by my future wife(in this case, no document will be required for her as she was never married.)
Thanks for the confirmation.
Does it have to be a divorce decree from the court? The reason why I ask is, under Hindu Marriage Act in India, my caste falls in a category wherein a notary from a lawyer stating that the divorce has happened (aka divorce deed) is enough for me to get remarried to someone else. Would this be considered a valid proof? My ex spouse signed the notary document without any hesitation, but now she is acting up to sign for d divorce decree.
