Expunged Dismissed Trespass charge in USA

4 Years back, I was arrested and charged with Trespass( Misdemeanor B). Pleaded not guilty at arraignment and case was dismissed straight without pretrial diversions or community service. I am trying to get the arrest record expunged so my police clearance certificate aka FBI report from the USA won't show up arrest record.


Once record gets expunged, Should I say I was detained in my express entry application or say I never got detained in any country. All I know is when a report gets expunged properly at state and federal, it won't show up in FBI background report but FBI can still have access to it for immigration purpose in USA

You have to always answer honestly. The question is "Have you ever been arrested... ... in any country". It doesn't matter that your record is now clean - you have to tell them about your criminal history, and then provide all the documentation that shows that your case was dismissed.

Since your case was dismissed, it will not cause any problems with immigration. Don't even think of not telling the truth - you will get banned for sure.

Were you convicted? No. Were you arrested? Yes.

If you have the slightest doubt, answer yes, and explain it later in the LOE with relevant documents. Being uncertain or playing dumb, then, answering yes to a similar question, while giving a detailed explanation about it is a better option than simply saying no.
