Express entry with my spouse who has pending ayslum in usa

hi everyone i have couple of questions if someone can help me out
I am going to apply for my express entry soon can i apply for my spouse aling woth me, who has pending ayslum in USA or should i wait and get mine first
Does he need to withdraw his case over there inorder to apply fir express entry in canada
We are originally from india do he need to go back to india to come to canada?
If anyone can help us out would be greatful.

Recommend you post to the Express Entry section of the forum.

You will need to include your husband in your Express Entry application as a dependent. As part of this process, he will need to have a valid passport available.

Depending on how long he has been out of status in the US, he may be given a 3 or 10 year ban as soon as he leaves the country.

Thank you. He is still waiting for decision in his case but we need to file for him along with me in my express entry will that have negetive impact on my application should i wait or we can do it together. He has vaild passport
