Expired visa in US

My friend H1 Visa expire (but stayed legally in US for couple of years) and she applied for
PR in Canada.
Can she get a police clearance knowing that she already on illegal stay. Is there an
concern that her status will be check?

please share any idea/experiences. Thanks

I believe she could. Just let her bring her passport for identification. probably have her remove the I-94 just incase the one's gonna do her fingerprint fish around.

No issues unless your friend got arrested by ICE. FBI or state police will not check her immigration status.

Is passport required in getting her police clearance? (She still has her valid driver license).

I hope this is not a concern for her in getting a police cert.

Hello mate,

She might get through the PCC clearence but when they ask her passport for stamping they are going to find out that she was illegal in the country and refuse it.


I am surprised that CIC intake office did approve your case because they ask for Visa stamped pages if you are not national of that country.

Got my police clearance(finger prints taken at a police station) with drivers licence in Michigan, no issues. Just a valid photo ID, so Drivers licence of Michigan was enough passport was never asked to be shown.
