I applied for canadian Green card under FSW. I am currently on H1-B visa in USA.

Application received by cic: Not sure as I used USPS
Draft Cleared: June 29, 2009
I am software Engg and have 4 1/2 years experience. On the from IMM 0008 (Schedule 3) the NOC I wrote was 2173.
I was just doing some research on cic website and I found that "Software Engineer" is not listed in the cic website

Am I really eligible for FSW category ??
I know the draft is cleared but why is S/W Engineer not listed in that website.
If your duties and designation match 2173 Software Engineers, that is your Noc Code. A lot of people try to fit their profession to one from the list but they eventually get rejected too. You can still try to find a job offer. Good luck!
Check out 2171, 2173, 2174 for software professionals. Depending upon your duties, you are likely to fit into one of those. If you hold a mgmt position, 0213 is the NOC category (which is the only one of the above mentioned which exists in the ministerial list of 38 occupations).
The only option for a software engineer to be able to immigrate to canada is to be a manager or provide a proof of doing managerial tasks as his key duties.
In ur case if you can get a reference letter from current employer or proviude sufficient proof of this :manager part , u can reapply again.
u have no other option but to choose '0213' - computer and information system managers.
The only exception is if someone has studied in canada/worked in canada (stayed in canada for a minimum of 1 year)
In your case i think your application is headed for rejection , if u can . provide a proof of work experience as per the duties of NOC -0213 ,then start preparing for another application.
I just don't understand 1 thing, why do they en-cash the draft even thought the application is rejected.
I guess I might be the first one in this forum who knows that draft is cashed in advance and a rejections is on its way
all because of my lack of research.

They cash the draft first, then they decide if you are approved. The cost of lending them money for a few weeks you can look at as a fee for your pre-processing, that is to tell you that you don't qualify.
Besides, why is your dream over? There are other ways to qualify.
