Do I need to fill out Statutory Declaration of Common-Law Union (IMM 5409)?

This form must be completed and signed by the sponsor and common-law partner, only if the latter is a co-signer on the application

Do all sponsors need to complete the form? Does the above statement mean that the common-law partner must also complete the from only if he/she is a co-signer and not that one must complete this form only if their common-law partner is a co-signer (which, I guess would be impossible)?

Technically for spousal apps, this form does NOT need to be filled out since as you said it states clearly it's only for co-signers. We never did it for our common-law app and had no problems, and many other people here didn't do it and had no problems either.

HOWEVER some people on this site have had the VO ask for this stat declaration during the process. I think this comes more from particular VOs so is not the norm. So it's really up to you if you want to do it or not to be safe, though as mentioned it is not an actual requirement so I wouldn't worry if you submit without one.
