My employer is in USA and I work in Buffalo while I live in Toronto. Since I landed in july 2009 in canada, i have not filed taxes and only have returns from USA. Do I need proof of income and tax filing for spouse immigration? My pay stubs show USA address because my company cannot deposit in Canadian Bank.

I have the same situation with only difference I don't have paystubs - I'm self employed. I would assume that the letter from employer would be sufficient and maybe printout from your bank showing deposits. However, as far as I know if you are sponsoring spouse there is now min income requirements, thus I believe US employer shouldn't be a problem.
I haven't sent our documents yet since we are still waiting to receive FBI records and other stuff, so can't say for sure. Maybe somebody on the forum can share their own experience.

I've heard of Canadians who are living overseas sending their pay stubs and tax information from whatever country they're residing in and they don't come across any problems. Whatever your situation is that means you won't be recieving an Option C Printout, just provide an explanation as to why you don't have one and include a letter from your employer, pay stubs, bank deposits (that's a great one kolibri, my husband is doing the same thing since he has direct deposit). They just want to see what you are doing, how you are making your money.

It is definitely one of the least stressful parts for the sponsor in a Family Class sponsorship as long as you provide them with information as to what you ARE doing and how you are making your money if not in Canada. No big deal! Good luck!

Hi Nyssa,

I don't believe it necessary AT ALL for you to provide a tax return/notice of assessment in order to sponsor your spouse as your financially exempt in a spousal sponsorship.

Good luck.

Yes, you are financially expect, but they still need to see that the sponsor is not recieving government aid or filing for bankruptcy.

#17 on the Sponsor's Document Checklist reads:

An original "Option C Printout" of your and your co-signer's last Notice of Assessment for the most recent taxation year. To obtain this printout free-of-charge from the Canada Revenue Agency, call 1 800 959-8281. If you do not provide this printout, provide an explanation on a seperate sheet of paper.

Yes that is correct because there is a minimum income requirement if you are sponsoring other members of the family class i.e. Parents, dependent children etc.

It does not apply for spousal sponsorships. If you don't send it in, it will not affect your eligibility as a sponsor.

While assessing your eligibility for sponsorship, they conduct an investigation on you. Cross-reference your personal information to check for previous bankruptcies or applications for social assistance.

You MUST include an Option C printout or your application will be returned to you. They do not request it for proof of income in the case of spousals with no dependents, but because it also contains additional information on bankruptcies and social assistance. That is why a simple notice of assessment is not enough.

So: You must include an Option C printout. Whether or not you have dependents makes no difference.

They assess your eligibility to sponsor by reviewing the information in Option C. So you must send it in. However, if there is a reason why you CANNOT send it in then you need to write a letter explaining why. If you simply don't send Option C and you do not explain why you haven't sent it, then they will very likely return your application as incomplete.

You dont have to include option C I didnt I am self employed i just put how much i earn no explaination and that was it and my app was approved no problem

And you were sponsoring a spouse? If that is indeed the case, lucky you!

However, someone else might not be so lucky, so I recommend including all the required documents so you don't risk having your application returned unprocessed a few months later...
