Hi all,

I have a bit of complected situation here,,, and i really need help as i am new to this country, I landed in 2010 and me and my wife had few wife and husband arguments like any normal couples after 6 month of me being here, so we slept up for like 2 month then got back together then again we fought but this time it was a bit verbal abusing both ways i wont say just her or just me, so we got separated again, then after few months we got back and then stayed together for like lets say 7 month and then long story short she kicked me out the house again and that was not the 1st time it happened so many times as that really made me feel so much hurt, anyway now she want a divorce and is threatening me to deport me and she called my embassy and had them call me to go and divorce her, i need to know if i did go and divorced her in the embassy, Does that have any interference on my status ? and why she insets to divorce me 1st there then sign separation papers while we are separated since Jan 2013, i am really confused and i really need some advice of what to do, i never took one dollar from her i did help her alot here and even before i moved to live with her and that all came from my bank account, now she claims that she can deport me and have them remove me from the country , please advice thank you
 
She cannot have you deported or damage your PR status in any way. These are "empty threats". This is assuming that you are a Canadian permanent resident. The fact that you stated that you "landed in 2010" makes me believe so.
 
Well thank you but what i don't understand is why she insists on me divorcing her at my embassy where our marriage took place in my home country so does that mean she can use that ageist me?
 
I would suggest that you ignore what she "insists" on and take advice from your own lawyer. As it seems that this divorce could be acrimonious, you will probably need one. The other thing is that as you both reside in Canada, any divorce must comply with Canadian Law, not your embassy. Separation papers come BEFORE a divorce, not afterwards. I think she is trying to trick you in some way... You need professional assistance to avoid giving up any legal rights that you may have.
 
Well like i said she went to my embassy and had them call me and they asked me to come and divorce her upon her request? ... so i am not sure... what are her possibilities to get me deported and what if i ignored her and just signed the separation papers? and the other thing is even thought the marriage took place in my home country does that mean that in case of a divorce we don't need to follow the Canadian Law and if i went and divorced her in my embassy like she asks does that mean she can use that against me? sorry if i am repeating my self as i dont know what to do really?
 
You are in Canada now. You follow Canadian Law.
Don't sign anything.
Don't go to the embassy.
Don't let your wife threaten you.
Don't panic.
Do see a Canadian lawyer.
 
Well thank you,,, i will try to book an appointment with a lawyer but is there any one else can advice till i get to see one?
