Actually you have to be legally separated for 1 year before you are allowed to be granted divorce. Only then you can re-marry the day or the day after official divorce.
Right screech, my bad.I was thinking divorce, but is true, the 1 year separation first. Once divorce granted, in Manitoba, you need to wait 31 days after the divorce judgement was granted, before remarrying.
You must also of course, apply for a certificate of divorce from the same courthouse, for proof of divorce, before being able to marry(obtain a marriage license)
What rice-racer wrote above also make sense. You would have to be separated for 1 year before you can fill for divorce. Once you are granted a divorce, I suspects you would need to obtain a divorce certificate first so that you can obtain your marriage licence. Only then can you re-marry another person. Mind you this is Manitoba rules. If you plan to get married outside Canada, you would still need divorce certificate as proof you can marry.
Once you get married, you cannot sponsor your new wife for 5 years after you landed. So if you were to get a divorce 1 year later and you got married shortly after, you may have to wait up to 4 years before you are allowed to sponsor your new wife to Canada depending on when was your landing date was.
The 5 year sponsorship ban applies to those whose spousal sponsorship was received on or after march 2, 2012.
So depending on when your application was received you could or could not sponsor your future wife. I cannot answer this question as I don't know when CIC officially received your PR spousal sponsorship. Only you know the answer to that.
If your application was received by CIC before march 2, 2012, you are not subject to the 5 year ban. You would be able to marry after 1 year of separation plus time required to be granted a divorce and time required to get the divorce certificate.
