I have applied to sponsor my mother after my father expired few years back and now got the 90 days letter to update the forms. When applying i did not realise that i can add my brother as dependent type c as after my fathers death i kind of got in rush to sponsor my mom and also always thoughts dependents are always minors.
Now i have got to know about type c and want to add my brother before sending updated forms. My brother satisfies the condition of type c. Is there only some medical conditions which are covered under c. I mean is it only physical or mental disability as well? Also, if i add him now, the problem is he is having a wife and 2 cute little daughters. Will i be able to add his wife and daughters as well. Please advice.
If he is married then he doesn't qualify as a dependent and doesn't meet the criteria for dependent type C. If he was unmarried, then you might have a chance.
Are you an immigration lawyer? It no where says on the website that dependent type c cannot be married. Also for that sake even dependent type b who are married are eligible. Do you still think marriage is a criteria for type c?
You had to add him at the time of original application, he had to be under 22 or over but a pure dependent and studying till the app was finalized. I assume he over 22 now and regardless of being married with kids - he has a pure genuine dependent i.e living at home with parents and studying
I suggest you read parents thread where those were 22 have a hell of a time trying to convince the VO that they are studying ( which they are ) but has to be matching the original course
For hypothetical sake, say you were able to add him now - your LICO will shoot up
You ( assuming you are single ) + Mother + Family of 4 = 6 ie., around 56K/year
But in your case, a married brother kids will be impossible to show as a dependent
Sorry, but you can't sponsor him. He can come on his own on work permit or other PR option
