I am a naturalized Canadian Citizen residing in Canada, and recently married to a Romanian citizen. I intend to sponsor my wife and her dependent child from a previous marriage. She has sole custody of the child. Does she need permission from child's father before proceeding with the sponsorship and permanent residence applications, or is any requirement regarding approval from the non-immigrating parent of a dependent child being sponsored?

From reading this and other forums I think it all depends on the actual custody decision in your wife's particular case. For example your wife may have sole custody but does the father have any visitation rights? In that case I would think you would definitely need permission from him to take the child abroad.

I'd suggest a thorough read through of the paperwork might help clear that up for you.
 
I AM GOING THRU THIS AS WELL, I HAVE FULL SOLE CUSTODY BUT I STILL NEED(sorry caps) a letter from their father or a letter from the court giving me permission to remove them from the jusrisdicition of the court, in other words to move them out of the country. As long as the father has parental rights wether he has any part of the custody or visitation or not, you will still need to get a letter from the court or him.
 
I think tamee is right here. All necessary document must be provided to avoid delays or complications.
The required document is peculiar to the situation/case.
