True but I think on a US transit visa they will ask if she has ever been there before, and when her PR is being processed they may investigate her answers to the transit visa application. Or we could always have her say no on it and justify the response with the situation that she never had legal status in the US and no way to prove she was there we thought it would complicate things to include something that can't be proved by tying it to a legal SSN...

I personally wouldn't lie on anything - but your choice. She already has a 10 year ban from the US. Lying on a US application is misrepresentation. Misrepresentation carries a lifetime ban in the US. Obviously your call.

Read the other posts. OP's spouse lived and worked illegally in the US for years. The only way for her to get into the US and make it to a land border is to lie and hope that the US authorities don't catch her, which would really not be a smart thing to do.
 
They are between a rock and a hard place. Living and working in US illegally will be an issue in either inland or outland application. I would think doing an outland app will take much longer than the 16 months indicated at the CIC web site. From what alemoo had said, the marriage could be no more. For them to have any chance at all, alemoo needs to bring the family into Canada and do an inland app. How to do that is another story.

exactly, that is my worry and desperation. I'm worried that our marriage will be done by that time if it is an outland application because like I said before, she has absolutely nobody to help her . We talked to all of her friends all of her cousins everybody in her family and nobody wants anything to do with her.

what if she meets somebody there? Somebody who's already self-sufficient and loves her daughter. I know that she loves me but when you're completely hopeless and there's nothing else in your life, there comes a time when you begin to wonder what is the point of doing all of this and when is it going to end When you meet a man in Mexico who wants to be with you and is already able to provide for your daughter and give her the life she needs

I don't want the mistakes that we each made out of desperation to put a strain on this and destroy our marriage even further. tomorrow on my lunch break I'm going to the border patrol next to my work and I'm going to talk to them and find out everything I can.

given the situation and how hard it is for us to be apart, is there any possibility that they would help us out of compassion? Like give her some kind of a temporarily restricted travel visa under certain conditions?

her mother was screaming at her every day. She made her sleep at the kitchen table in a chair leaning up against the table with a jacket for a pillow. she never let her sleep in her own bed with her daughter. She had nowhere to go, no money and nobody would help her and she can only wonder every day how she was going to get out of this mess . So that's why she left to the US and she stayed there for two years. she was kidnapped and raped the border before she crossed

yes I have very little money right now but I'm going to in the future because I have a full-time job and will have very low expenses but I want to be with my wife and my daughter . when I was filling out the sponsorship application one of the questions was if I defaulted before on an immigration law if I remember reading that correctly... does anybody know what an immigration loan is? I really need to help but there is nothing I can do right now because it's going to take months and months to save up money

Sorry if I come so directly, perhaps I don't understand the full story, so let me ask:
You're making $17/hour full time, so at least $2600 monthly, $2300 after tax. If you rented a room in Toronto for $650/month and spent a generous $650 on groceries, metropass, cellphone and utilities, that still leaves you with $1000 excess. Why is that not enough to submit an application?
 
Working a second job wouldve been another option.

I was able to visit my wife 3x, for 5 months total, and was able to pay for a wedding 100% while still paying a mortgage at home. I did it by working a second job. Its not ideal, but I knew I didnt have to do it forever

Also his wife needs a police clearance from USA as she stayed over six months there...wait a sec...on a fake ID? How this issue will be looked upon by CIC ?

I don't think alemoo has a choice, unless he wants to abandon the wife and daughter which should be a no no in anyone's book. He just has to try it and see how CIC respond to the app. At worst CIC will reject it, but than alemoo can appeal.

As for the police clearance, is she was never caught and never finger printed, I would imagine the policy clearance will come back clean.

I've been working close to 80 hours a week for almost a year now and while I can only take two weeks vacation at a time I've also visited 3x.

Gotta do what you gotta do.

No, it's ok, you are just providing options. I am in Ontario and after tax it is about $2,100 a month, and I am viewing rooms after work today for $450 a month. Still working on trying to reach out to the Border Services. I hope they can help but I suspect it is going to be by the book.
 
I think you're not in such a bad shape. I wouldn't put too much value on talking CBSA at the border. Whatever they tell you there is not any guarantee of what is actually going to happen if your wife arrives, it really depends on the agent. I'd say save your money, and apply for immigration now. It does not cost that much if you don't do the medical upfront and do not prepay the landing fee.
