Hope you can help. I am a Canadian citizen by descent and my son & husband are Italian and South African citizens. My son is 3rd generation born outside of Canada so technically I understand that he is not entitled to citizenship, but the CIC website says each case is different and the official way to check is to apply for proof of citizenship. So I am not sure how to answer Part B, question 3 on the checklist IM5533E.
Because "yes" we technically do have a child together who MAY be a citizen as the checklist states, but "No" probably not based on my research. Do I need to do the whole proof of citizenship application just to prove that he is NOT a citizen? It says the app wont be returned but I am worried this issue would delay the app.

The requirements for him to be entitled to citizenship are fairly straightforward, so if you are confident he's not entitled to it, you can just check "no" and provide no additional documentation. Have you or your parents ever worked for the government? That would be the only thing that could potentially change the outcome (if your parents were working for the government abroad when you were born, etc.) which is why CIC says some cases may be different.
