My wife had been working and paying EI premiums up until her Work Permit expired just before we submitted our Spousal Sponsorship Application + Open Work Permit. While we are waiting for her OWP, can she apply for EI? We should have called EI and inquire about it but just wondering if anyone ran into a similar situation?

The answer is No. You must hold a valid work permit to acces employment insurance. The issue is her SIN number is expired too. I applied and received some when I had a baby but as soon as my permit expired they cut it off until I got a new permit.
