I am a british citizen who is about to process his PR Applciation.
I am currently awaiting a court verdict for a DUI charge which was adjourned from Feb to April 2010 and by getting a curative discharge will mean I won't get a criminal conviction.
I was wondering as my UK police check will be out of date by April whether I could send my application now as the first stage of approval takes on average of 4 months. By that time my court date will have gone by. I won't have wasted any time while I waiting for my court to go by. Also my Canadian police check that is done by CIC will occur during my first stage of approval.
I have the option of sending my inland application to London, Buffalo or Mississauga?
Where is the DUI from, UK or Canada ? I presume AB, Canada? If so, a person who is given a curative discharge will be placed on probation with the strict condition that a treatment program be taken. If the person completes the treatment program successfully, the conviction is not registered on the criminal record. A person who is given a curative discharge will still receive the normal licence suspensions.
Curative discharge is quite rare - I believe you should declare any offence as pending and volunteer information if your status changes part way through the process. If you're in Canada, perhaps give CIC a call and ask specifically. You could also file your application and update once you know the outcome.
As for where to send your application, I believe that inland send all (sponsor and PR app) to Vegreville and specify the preferred office for processing on the PR form where indicated.
