He would simply say "no status" or "out of status" in the application.
If you have 530, then you don't need to improve your score and should be selected immediately. Are you sure you have 530? This is quite a high score. I'm assuming you have a PhD, job offer supported by an LMIA, etc.
yes you are right that was quiet high, I made an error earlier in the initial CRS check. I redid the CRS and currently only have 459 points. I currently have Masters degree. Is there any way for me to improve my score fast?
Yes - agreed with the above. He has zero chance of securing a work permit in Canada. If he wants to move here, it would need to be under a PR application.

Fastest way is to retake IELTS and achieve a higher score to make sure you have maxed out these points (a job offer won't happen so forget about that). 459 is unfortunately too low to be selected. You really need in the range of 470+. Or you need to look into the PNP programs.

Also - not sure if you have calculated the score for just yourself or with your partner. If with your partner, you could list him as non-accompanying, immigrate yourself and then sponsor him afterwards. Downside of this is that you'd end up being separated for most of a year since you'll need to live in Canada to qualify to sponsor him and he won't be able to come here until he has PR.

yes I noticed that my score increased to 481 if i input myself as a single person is there a reason for that ? Yes the down side is horrible since the main aim is for us to be together in the same country.

I have looked into that option but he home office will not accept the application unless he has legal status in the country that the application is being submitted (USA).

He could return to his home country to normalize his status that way. That's always an option. It's probably still the fastest one if that's the priority.
