in the event a spouse sponsorship application was denied and an appeal is made in Canada and the sponsor is a Canadian citizen can the sponsor travel to be with the foreign spouse indefinitely until the the sponsor has to attend the hearing?

Highly unlikely IRCC would approve a TRV if the spousal application was refused. You would have to wait for the outcome of the appeal and sponsorship.
