Hi. Im a Filipino, separated from my wife, and currently in the middle east.
Me and my ex wife applied last year for a family visa but it did not reach the quota. so all the papers are just waiting for the new quota year to open.
She still wants to pursue Canada with my son. The problem is, i dont. I am filing for annulment asap. For her to get an immigrant visa with my son, she has to apply for family visa.
1. will it affect the application while an annulment case is pending?
2. if i postpone annulment and the appication is approved, will i be obligated to land "with" them?
3. will it affect their transition to residents if she gets annulled?
You say that you and your ex applied last year for a "family visa". I don't really understand what you mean by that. Canada allows citizens and permanent residents to sponsor family members from overseas, but someone without a family connection in Canada cannot just apply for a family class visa. A person applying to immigrate to Canada as a skilled worker, or business entrepreneur, etc., would include their family members - but that's not a "family visa" the way it's understood for purposes here.
So, in order to answer your questions about whether or not your wife can pursue the application without you, we need some clarity regarding just what type of application was submitted.
