Allowed to work while waiting for PGWP+PR?

Hi there,

My wife currently has a study permit valid until July 25, 2018. She graduated from a full-time 2-year diploma program at the end of April, and applied for her PGWP in June (no response yet) We are also waiting for her PR under the spousal sponsorship program (applied August 2017).

Simple question that I cannot find a simple answer to - is she allowed to work under the current circumstances?

Yes - she can work since she has applied for her PGWP.

For the PR spousal sponsorship application, did you apply inland or outland? If inland, did you include an OWP with the application?

We applied inland, but did not include an OWP application.

Too bad you didn't include an OWP - that would have been the best option since this would have given her implied status until a decision was made in the PR application. Because you didn't include an OWP, this means she receives no benefit from having a PR application in progress with regards to her status in Canada.

But again, since she's waiting for the outcome of the PGWP, she is fine to remain in Canada and work. Just a pity you didn't submit the OWP since it's guaranteed that would have been approved and this would have fully safeguarded her status in Canada.

To be honest, we did check the little checkbox that says "I am also including an Open Work Permit application". However, we had no idea that the OWP is a whole separate application that had to be attached with the sponsorship papers. This was not made clear in the PR application at all. We saw the checkbox and assumed it meant that CIC can use the information included in the PR application simultaneously to apply for an open work permit for my wife.

I really wish things like this were made much more clear up-front, to avoid missed opportunities like this.
