M so sorry to hear bout ur Denial. Did they give u the reason like on what bases they are denying ur appeal. M so worried now. I think u he the option left is federal court or reapply with some new evidences. I know it's very hard for u to face this tym but be strong and keep trying u ll go through soon.

Hi, the refusal was based on the marriage for purpose of going to Canada!! Because I had been before in Canada and got deported!! Please dear how long is the waiting for federal court? Is going to be hearing or just pepper work!? How long I have time to apply?? Please help

Hi, these you should find on any emigration letter you recieved from them or from the decision you got from the previous interview applicant had from the other contry! If you have the decision read it should be on the top of the decision letter!!

I think you need to consult with a lawyer, if you don't already have one. The judicial review is not automatic. I believe that the Judicial Review is only granted if there is an error in application or interpretation of law by the IAD judge. You will need to find case law that is relevant to your situation.

Do a search for judicial review in this forum. It sounds like there is a long road ahead. If you win the judicial review, it goes back into the appeal process before IAD, from the looks of it:

I have been gone for quite so long but now i am back with a great news...we won the appeal at last!!! It was such a long legal battle and we finally have proven the merit of our case. Quite few members in here were kinda negative that we will win our appeal case but me and my partner just keep going and being steadfast that we will make it in the end. After we lost the 1st appeal case, we never stopped. We seek for the another legal avenue where we can fight our case. We ended up filling before the Federal Court for leave and judicial review and we won the Federal. So our case was sent back to IAD for re determination and be heard by different member. We had our 2nd appeal case last March 21, 2016, we received the decision last June 4, 2016.

I am so happy the we finally won our appeal. Thank you for all the advice and comments. It made me strong to move forward and go for it. I have a question though, how long will it gonna take before i can finally get the visa? Hope to hear from anyone.
