The CIC officer told me I can return to canada after the 1 year ban is up. she said time would fly in no time at all, i can return.
She also suggested we hurry up and get married because that would sort it all out.
Getting married won't change the fact that you have a 1 year ban.
However it should make the sponsorship process easier since it may be difficult to prove you are common law if you have not declared yourselves as such in taxes.
Reading this series of posts makes me think that OP might not actually BE common law. Although she says they have been together for 10 years, she also stated she never stayed with him for more than 6 months at a time because of visitor visas and such. Without cohabiting for one full year to achieve common law, although they have a long relationship behind them, doesn't sound as if they are actually common law for immigration OR for tax purposes.
I missed that part, but now the question is, is it a full 365 days, or just 'close' to 1 year? Lots of folks would say 1 year if it was 11 months, so ...

ofcourse their case for CL is very weak and I think the OP also realizes that. hence it was mentioned that they are now planning to get married in London.

Then by law, your S/O really needs to try to amend his tax returns to reflect his common law status. Even if you did not make an income, he should still be listing you as his common law partner. I know you plan to get married now, which is good considering the lack of evidence you apparently don't have to prove common law. I would however have him try to straighten out his tax status so it doesn't come back to bit him in the arse end at a later date.

Thank you and god bless you all, i hope you recieve your Permemant residence sooner than later. I cannot wait to get married and once the 1 year ban is up, i am looking forward to applying for PR. It looks like alot of paper work but i cannot put it off any longer, putting off all that paper work is what got us in to this mess in the first place.
