Currently, I am separated my husband and I put 'legally separated' on the imm0008 form.
1)Do I still need to put the details of my husband as a defendant on the imm0008 ?
2)Do I still need to file his imm5669(background declaration) and imm5562(travel) ?
because we are not divorced yet (the guide says I need to fill about all the family members if they are accompanying or not)
or I just need to file mine.
'Separated spouse' should be a defendant or not ???????
I got the separation agreement paper from my country which has signed from both of us.
I will attach this document to prove my legal separation.

But if my spouse doesn't want to provide any details about him and he is not going to sign any immigration papers.
I don't want to include him in my application either.
Is there anyway to explain this situation to CIC??
When will you get legally divorced? Can you wait until then?
If you can not wait until then (maybe you are trying to make a cap or a deadline), you can try applying as separated, leaving your husband off your application, and writing a cover letter stating that you are separated with zero chance of reconciliation and that your divorce will be final on date x. Then see what they'll do.
I wish I can wait.
I will try 'Affidavit of Separation' first and I hope the separation agreement works as well.
And both of document will be notarized before I send them.
