I applied for H&C for the second time in April 6 2022 with new documents and evidence about the victim blaming both the imm officer and the imm judge did regarding my imm case. I summitted sentencing and judgement documents about a sexual assault against me that happened in Oct 2018
My first application (sent in August 2019) was rejected because "I made allegations about SA (sexual assaults against me)" even though we sent documents from the police and crown prosecutor with the charge being laid against the offender...well, it seems like the officer did not believe me, SMH.
My lawyer appealed the rejection and it was granted...
8 months forward the appeal was rejected because the judge said that: "I (me, the applicant) like to put myself in dangerous situations and it is my fault that I am a victim of crimes"
We were not given notice about the rejection until January 2022 by the border services ( the appeal was rejected in October 2021)
Anyways, now I have to get a new passport to start the process of my removal from the country...
My lawyer's plan is once I get the departure order, then he will ask for a deferral, if it is not granted, then he will apply for the stay of removal.
How can I cope with the fact that life is unfair and I might get removed from the country? How can I forgive myself for wasting years of my life dealing with immigration, the crime against me and the court system ( which took around 2.5 years because the offender pleaded not guilty and blamed me for it)??
I feel horrible, and to make things worse I am dealing with depression ((( I trust that my lawyer will do his best to put the departure order on hold meanwhile we get the result from the 2nd H&C application, but I am exhausted mentally and physically (((
To those who are dealing/ dealt with similar circumstances to mine, how do you keep moving forward? I can't sleep well, I can't eat (((
