Could you kindly advise our case below?
I've applied for sponsoring my partner in October 2023. My partner's work permit will be expiring in 8 months. However, we got a Procuredure Fairness letter (which we are working with a consultant to address their concerns and will send an explanation letter next week). I wonder if my partner can apply for the open work permit during the PFL process (as I've heard that no identified timeline for their response to PFL). Thank you.

You can sure try to apply. But with PFL, I am not sure if the OWP will be approved.
Do you want to share why you get PFL? Were you common law parnters before you landed as PR and didn't declare? Or you already did include your partner as non-accompanying but there is some paperwork issue with other doucments or the forms that you provided (e.g. US visa refusal that was missed) ?

We are currently waiting on our marriage certificate we were told it takes about 8 weeks to receive. But the issue is i have some family commitment’s in USA for which i have to stay in the states for 4-5 months. Is there a way we can start our spousal application while i am in USA and my wife in canada ?

when is the best time to apply for an Open work permit? My work permit expires in May. Do you know if I can apply for OWP now? I applied for PR through spouse sponsorship. I also already got the Pre arrival, and both myself and my sponsor passed the eligibility. My AOR was September 7.. also i am worried all stages are completed but no email from IRCC and the COPR number is not visible on the tracker

You should have applied for OWP when you received the AOR. I recommend you to apply for the OWP now so that you are given maintained status in case your work permit expires in May.

I agree with bluefire, you could have applied ro OWP after AOR and you likely would have got the OWP now.
Anyway, apply now so that you will have maintaince status until your PR is approved.
