2 REFUSALS ALREADY, NEW APPLICATION WITH LOTS OF CHANGES! NEED REVIEWS.

As per @sqfit we are having the authority to file our application from India.... while we are physically present in Middle East.

Have you been successful doing this? Why aren’t more applicants doing this then if you can just say they have the “authority” to file from their home country? Is this just for India? This would change all of the way study permits are processed. This is important information since IRCC has processed from the country you are applying from/residence not your country of citizenship. Many people have moved back to their home country to apply and wait for a decision. If this isn’t the case now, please post the changes (IRCC directives).

What do you mean you are having authority? You mean that is allowed by the Immigration Canada? You can be in KSA and file as if you are in India?

8. Past 5 years residence history if different from 7.
9. Country you are applying from: same as country of residence mentioned above (yes) or (no)
Then goes on to give you options to choose from and you have to specify your status from where you are applying.
You can apply from elsewhere if you have some tie to it or else you can’t.
If it wasn’t allowed to apply from places different from your country of residence then why do they give you the option to choose yes or no and to proceed on to apply from elsewhere, they would just straight up consider your application only from the place you are at right now.
If you guys have any guidelines as to why they have given that section yet you can’t make a choice, let me know.
One thing they should clarify further to avoid this confusion is to make it clearer if you are a permanent resident of the place you are currently at or like us aliens with worker status (and family is dependent on spouse’s/parents’ worker status).

I thought you are Permanent Resident in Spain and have Spain Residency Card/Status. So all the advices that everyone provided was wrong and misleading based on what you posted that you have PR status in Spain

I thought you said you have PR (permanent residency) in Spain? If you have to renew your visa periodically then you are on a temporary residence. This means you still have to contend with the issue of immigration status in your country of residence.

Its not a visa...... and it comes under Permanent residence when we fill any kind of form... when we come from India directly as PR on the basis of family, first we get a card of 3 years and we have to renew it after 3 years and later with second of 5, after 5 years I have to renew it...,y family has PR with a renewal period of 5 years until completing 10 years to get a passport...coz everyone has to renew it by giving the biometrics after 5 years

I was reading a thread not too long ago on the Foreign Worker forum about someone who applied for an IEC visa that only residents of countries are eligible for. Such country included Spain. This individual had a Spain passport but was not resident in Spain. They used their family address in Spain but was refused and I think they got into trouble for misrepresentation or something ( I just skimmed through the thread so can't remember all the details). Not saying you can't apply SDS in your case, but if you do, make sure you have all your documents and trails correct.

No need to scream or get worked up. I specifically posted that to highlight the fact that IRCC puts weight on your country of residence not on your country of origin.

AFAIK, even if one applies under SDS but did not meet all the criteria, then that application is treated as a non SDS application. Please do correct me if I’m wrong.

In that case you'll likely get rejected because you wouldn't have provided the extensive documentation required for non-SDS.

I guess we are all confused with simple question and answer. It should be situational circumstance not your choice on question 7-9. Not all countries has vfs or embassy, and one embassy can process from different countries. Then comes how long you have been in that country. The way you interprete those questions can be different. If you live in UAE, have some ties ( social or economic ) then UAE which is your current address is your country you are applying from. Total concealing can be misrep
