None of the Commissioner of Oaths in my wife's city speak English. It has been our experience in Ukraine that a Commissioner of Oaths will not sign/authorize a form that is in English language since it is not their native language.

if you are applying common-law etc i do not think you need to fill out this form. You need to fill it out when you and your common-law partner are
co-signing to sponsor someone.Read more into it i think this is what you will find and it will save you the hassle.
If you are married you don't need to fill out this form, my common law spouse and I did it, because this is a proof of married-like union. But if you are married definitely you will have the married certificate, so not need of this.
Thanks for noticing that. I think you are right. To me it seems you only have to complete IMM5409 if your common-law partner is a co-signer as a sponsor and NOT if your common-law partner is the person being sponsored.
