Hi all,

In spouse OWP which opened yesterday , there is this clause. My PGWP expires in Sept 2023, In order for my wife to apply this, Do I need to apply for myself? I still have more than a year, How it works? Please help

You’re eligible for an open work permit if you meet all of the following:

  • you’re a spouse/common-law partner or dependent child of a principal applicant for the permanent resident (PR) pathway
  • you’re 18 years of age or older
  • you’re in or outside Canada
  • you apply online
  • the principal applicant applied and is eligible for an open work permit under this public policy
    • Your application will be refused if the principal applicant has not applied for an open work permit under this public policy.
  • the principal applicant included you as an accompanying family member in their PR application
If you’re a family member in Canada, you must also

Yes. You need to apply/ have the WP for this public policy as well.

i have lost all hopes from this policy & from Fraser. I just want my new work permit & I will hope to get pnp in a year
You think PNP is any better ? I got nominated by Ontario last October. Applied for PR to IRCC based on that in January since I did not even have a file number for my TR to PR. I am still waiting for AOR on my provincial PR application :))))))

Did you submit an old medical or a new one? Not needed indicates valid but expired medical. Most of the time, the officer extends the validity but if they need new medical, they will send you ADR. For your second question, eligibility and security. It depends upon your file and officer. But, I think all of the Feb AORs officers are on vacation or busy with other applications. As TR2PR processing officers are given a deadline of 1 yr to give results based on my GCMS and many others.
I submitted the new one (Visited on May 19 2021). My CBSA notes mentioned that my medical results are valid until June 3 2022. My status also changed from passed to do not need on June 3.

Also, assignment due date for my file on CBSA notes is June 3 2022.

Unfortunately, I am still awaiting the PR for myself and my outland spouse. Hence, I have decided to apply for the Open Work Permit under this new policy for my outland spouse.

While reviewing the requirements for 'Family members', I came across the following clause:
  • the principal applicant applied and is eligible for an open work permit under this public policy
    • Your application will be refused if the principal applicant has not applied for an open work permit under this public policy.
I did not apply for an open work permit as I had a PGWP till July '23. Based on the above clause, it appears that I also need to apply for an open work permit along with my outland spouse.

However, my passport is only valid till July '23, do I need to renew my passport before I apply for an open work permit? I am asking this because usually, the expiry of a work permit is the same as that of the passport. I will want to avoid this as renewing a passport means sending webforms and updating my TR to PR application which will cause further delays.

Looking for some advice so that I can get started with the process asap.

I also had the same question, because under the 'When you can apply' section it says the following:

You can apply up to 4 months before your current work permit expires. Your family members can apply at any time.

By 'current work permit', not sure whether they're referring to the PGWP or the open work permit applied under this policy.

Yes, generally regardless of the policy or program you're applying for getting your WP, they will not issue a document beyond the expiry date of your passport. So, if you can renew your passport now, do it first and then apply for the OWP.

Thanks for your response.

Renewing the passport right now might be too much of a hassle. I will apply with my current passport, which means I might get my new OPW with validity till July '23. Hopefully, I will get my PR by then. If not, I can look into requesting an extension of my OPW closer to expiry.

Does this approach make sense to you? I am just trying to save time now by accepting the risk of getting an OPW with the expiry of July '23.

You can apply up to 4 months before your current work permit expires. Your family members can apply at any time.

All other applicants and their family members
You can apply at any time if any of the following apply:

It's good for those who have dependent(s) outside of Canada, but I don't know if it's any good for single applicants, especially those who have already applied for the extension until end of 2022. It doesn't make sense to me to keep extending the work permit (and paying more money to them) just for them to process the files when most of the files are already almost complete (some exceptions for sure).
I suppose nothing has made sense since 2020.

My PGWP expires Sept 2023. Do I need to apply now? inorder to get OWP for my wife? AmI allowed to do it. They say 4 months before?

Anybody who received AOR in November and nothing after that. Still waiting for some news.
No GU, no ADR, work permit already expired.
I have been waiting for the portal since Dec 9. 5 times ADR requests, ADR reviewing after May 18.
Do you have any dependents?

I contacted my local MP regarding my tr to pr application status but MP wants me to fill form which includes constituent information and applicant information I'm not sure what should I fill in constituent information. Does anyone knows what should I fill under that section(constituent information)?
